LEGAL UPDATE: Attorney Excoriates DOJ Over Leaked FBI Document Categorizing Veritas as News Media [Video]

• In a new legal filing, Project Veritas Attorney, Paul Calli, introduced a whistleblower-obtained FBI document from a May 11th report. A source from the bureau disclosed to us “concerning” information about the government’s investigation of Project Veritas’ own investigation of allegations in Ashley Biden’s diary.• In court, the DOJ defended its unprecedented secret subpoenas, orders, warrants, and raids on journalists to seize nearly 200,000 emails and 47 reporter’s devices by arguing, “Project Veritas is not engaged in journalism.” The document, however reveals that when the investigation was opened, the FBI labeled Project Veritas as “news media” – directly contradicting the DOJ’s position.• Calli said the document is “substantial evidence of the investigators’ misconduct,” noting, “the government has acted in bad faith every step of the way ignoring First Amendment precedent and the protections afforded to journalists by the DOJ’s own regulations.”[NEW YORK – May 23, 2022] In a new filing, attorneys for Project Veritas highlighted an internal FBI document provided by a whistleblower which, again, calls actions from the Department of Justice into question. The filing introduces an FBI splash page about their investigation into Ashley Biden’s diary which shows a glaring contradiction between the government’s in-court position and the handling of the case.The document shows the FBI labeled Project Veritas “news media,” but as Project Veritas attorney, Paul Calli, pointed out, the government defended its unprecedented action against journalists by arguing otherwise.The filing, which was covered by Politico’s Josh Gerstein, clearly outlines what Calli sees as “substantial evidence of the investigators’ misconduct.” Calli argued, “The government recognized on Day 1 that Project Veritas is a member of the ‘News Media.’ This knowledge cannot be reconciled with the position the government took … that Project Veritas was not eligible to assert any journalistic privileges because ‘Project Veritas is not engaged in journalism within any traditional or accepted definition of that word,’” Calli said.The DOJ used 19 secret subpoenas, orders, and warrants which were presented to nine different magistrate judges. The DOJ then ordered three raids on journalists’ homes and, in total, seized nearly 200,000 journalists’ emails, and 47 reporter’s devices. Only 6 devices had supposedly “responsive” materials.Judge Torres is expected to rule on Project Veritas’ motion for its reporters’ property to be returned and its request for key information surrounding the case to be unsealed. Each motion was backed by other non-partisan non-profit organizations like the ACLU and the Reporter’s Committee for Freedom of the Press’ own motion to unseal. “This is a landmark case of government overreach, made even more egregious by its direct assault on the First Amendment,” Calli argues in the motion. “Line prosecutors and FBI case agents do not get to decide who is entitled to free speech rights and other protections guaranteed by the First Amendment.”About Project VeritasJames O’Keefe established Project Veritas in 2010 as a non-profit journalism enterprise to continue his undercover reporting work. This story features undercover footage of Lead Client Partner, Alex Martinez, an employee for the tech giant, who sometimes speaks on behalf of the company at events. This footage shows a very candid Martinez speaking about how the company’s “ideology” led them to be less “profitable,” among other incendiary comments.In the video, Alex Martinez also criticizes Elon Musk’s vision of free speech on the platform saying, “The rest of us who have been here believe in something that’s good for the planet and not just to give people free speech.” He also broached the subject of censorship on Twitter saying, “People don’t know how to make a rational decision if you don’t put out — correct things that are supposed to be out in the public, right?”Despite this, Martinez acknowledges that this very reality seems to be what Musk wants to change. “If we’re implementing all these rules…and Elon wants to dismantle them, then technically our ideology has led us to not making money because we’re not making money, and Elon wants to turn it the other way so that we can make money,” Martinez said.Martinez even made distasteful comments about Musk having Asperger’s. “He has Asperger’s,” Martinez says at one point adding, “so, he’s special.” Going further, Martinez later says, “We all know that and that’s fine. So here, no one’s going to say some f**king crazy sh*t because he’s special.”Last May, as he was hosting Saturday Night Live, Musk revealed that he was the first person to host the show with Asperger’s. In the video published on Tuesday, Martinez can be seen saying, “I’m like- you’re special needs! You’re literally special needs, literally though, you really are. He also says employees at Twitter are “stress-eating” and “worried for our jobs.”More significant than those soundbites are the reasons he says employees at Twitter feel this way.“Our jobs are at stake; he’s a capitalist and we weren’t really operating as capitalists, more like very socialist,” Murugesan says before adding, “we’re all like commie as f**k.”Murugesan also pointed to free speech being one of the core issues employees at Twitter have with its new likely owner, Elon Musk. When asked about the difference between Twitter’s definition of free speech and Musk’s, the Sr. Engineer left no room for interpretation. “Twitter does not believe in free speech,” said Murugesan answering the undercover journalist. Back in March, Musk said he was a “free speech absolutist” and clarified his comments further adding, “By free speech, I simply mean that which matches the law. I am against censorship that goes far beyond the law. If people want less free speech, they will ask government to pass laws to that effect. Therefore, going beyond the law is contrary to the will of the people.”Murugesan also explained how Twitter employees did all they could to “revolt against” Musk’s takeover of the company. “We did all we could to like revolt against it. Our reporting is fact based with clear and irrefutable video and audio content. Truth is paramount. We never deceive our audience. We do not distort the facts or the context. We do not “selectively edit.”Rule #2 – We do not break the law. We maintain one-party consent when recording someone is inherently moral and ethical. We never record when there is zero-party consent. In areas where we are required to have consent from all parties, we seek legal guidance regarding the expectation of privacy’s impact on our right to record.Rule #3 – We adhere to the 1st Amendment rights of others. During our investigations we do not disrupt the peace. We do not infringe on the 1st Amendment rights of others.Rule #4 – The Zekman Test. The undercover investigations we pursue are judged by us to be of “vital public interest” and “profound importance.” The Zekman Test is our baseline. Undercover investigative reporting is necessary because, “…there’s no other way to get the story…” Whereas the Society of Professional Journalists allows for undercover techniques, if undercover techniques are necessary to expose issues of vital public importance; we believe they are not only allowed but required.Rule #5 – We Protect the Innocent When Possible – Embarrassing private details are not to be investigated. We stay away from irrelevant embarrassingly intimate details about private citizens personal lives. We look for individual wrong-doing and judge its public importance. The irrelevant religious or sexual dispositions of our targets are not to be investigated.Rule #6 – Transparency. Our methods & tactics must be reasonable and defensible. We use the “Twelve Jurors on Our Shoulder” rule. The work has to be done with such a degree of integrity that it can withstand scrutiny in both law & ethics. We are comfortable with transparency. We must be willing to be ready to disclose our methods upon publication.Rule #7 – Verifying and Corroborate Stories – Evaluate impact on third parties and Newsworthiness of Statements Alone.We consistently consider the probable truth or falsity of statements, examine any reasons to doubt the veracity of underlying assertions and whether the assertions are newsworthy. When possible, we will confirm with our subjects that their statements captured on video are accurate & truthful. At the very least, we will give our subjects an opportunity to elaborate and/or respond. In all matters, we rely on the 1st Amendment to protect our ability to publish newsworthy items after our internal deliberations. On whether there is an obligation to ensure the veracity of statements made on video, 1.) consider whether the remarks may potentially impact an innocent third party. (Factors in support of releasing the content) and 2.)The Newsworthiness of the statement alone by itself. (Factors against releasing the content).Rule #8 – Raw Video. In certain circumstances we may release the “raw” video to the press and or the public. But as a rule, we do not.Rule #9 – Subject Anonymity. We investigate & question sources before promising anonymity. Once we confirm, we will do everything in our power to protect the identity of our confidential sources.Rule #10 – Being Accountable. Admit mistakes & correct them promptly.Rule #11 – We do not manufacture content. We do not put words in our investigative subjects’ mouths. We do not lead the horse to water. Our purpose is to elicit truth.Rule #12 – With Great Power comes Great Responsibility.
